After testing some products from S.A.N. Nutrition, we found 34 products we alleged to be in violation of Proposition 65 in regards to lead and/or cadmium amounts.  Below is the timeline of events of the case between ERC and Uni Key Health Systems.

Notice of Violation I

On September 12, 2018 and October 3, 2018, Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against S.A.N. Nutrition Corp.

In this action, ERC alleges that 34 specific products manufactured, distributed, or sold by S.A.N. Nutrition Corp. contain lead, a chemical listed under Proposition 65 as a carcinogen and reproductive toxin, and expose consumers to lead at a level requiring a Proposition 65 warning. It is also alleged that three of these products (listed below in italics) also contain cadmium, another chemical listed under Proposition 65 as a carcinogen and reproductive toxin.

These products are:

Civil Complaint

ERC filed a Civil Complaint on December 18, 2018.

Settlement

A settlement was reached on October 1, 2019. In full satisfaction of all potential civil penalties, additional settlement payments, attorney's fees, and costs, S.A.N. Nutrtion shall make a total payment of $61,250.00 to ERC.

Corrective Action

As of October 1, 2019 S.A.N. Nutrition has discontinued the production of the following products:

  1. Rawfusion Complete 100% Plant-Based Whole Food Proteins Vanilla

  2. Rawfusion Complete 100% Plant-Based Whole Food Proteins Chocolate

  3. SAN Titanium Standard 100% Pure Titanium Beef Supreme Chocolate Fudge

  4. Rawfusion Whole Foods Protein Bar Fueled With Superfoods Almond Berry

  5. SAN Titanium Standard 100% Pure Titanium Beef Supreme Vanilla Cream

  6. SAN Titanium Standard Alpha Impact

  7. SAN Titanium Standard MegaTron Muscle Pump Volumizer Green Apple

  8. SAN Titanium Standard MegaTron Muscle Pump Volumizer Watermelonade

S.A.N. will phase out the following products from its line of products within four to six months after October 1, 2019:

  1. SAN Titanium Standard Meta Force 5.0 Strawberry Cheesecake

  2. SAN Titanium Standard 100% Pure Titanium Whey Banana Coconut

  3. SAN Titanium Standard Fierce Domination Furious Fruit Punch

  4. SAN Titanium Standard Fierce Domination Ragin’ Raspberry Lemonade

  5. SAN SAN Exclusive Pro Series Launch 4350 Reloaded Orange Tang

  6. SAN Titanium Standard Fierce with T-Drive Tropical Mango

  7. SAN Titanium Standard Fierce with T-Drive Atomic Green Apple

The following warning must be utilized on products with lead levels over 0.5 micrograms: 

  • WARNING: Consuming this product can expose you to chemicals including [lead] [and] [cadmium] which is [are] known to the State of California to cause [ cancer and] birth defects or other reproductive harm. For more information go to www.P65Warnings.ca.gov/food.
