After testing products from Smartfruit, Inc., 3V Company, Inc., individually and dba Smartfruit, we discovered 3 products we allege to be in violation of Proposition 65 in regards to heavy metal contamination. Below is the timeline of events of the case between ERC and Smartfruit, Inc., 3V Company, Inc.

Notice of Violation I

On September 25, 2026, the Environmental Research Center filed a Notice of Violation of California Law Proposition 65 against Smartfruit, Inc., 3V Company, Inc.

In this action, ERC alleges that 3 specific products manufactured, distributed, or sold by Smartfruit, Inc., 3V Company, Inc., individually contain PFOA and/or PFOS, chemicals listed under Proposition 65 as carcinogenic and reproductive toxin, exposing consumers to levels requiring a Proposition 65 warning.

The products under investigation are:

1. Smartfruit Refresher Restart Lemonade – Perfluorooctanoic Acid (PFOA), Perfluorooctane Sulfonate (PFOS)

2. Smartfruit Refresher Restore Kiwi, Mint, Lemongrass - Perfluorooctanoic Acid (PFOA)

3. Smartfruit Refresher Renew Strawberry, Acai - Perfluorooctanoic Acid (PFOA)
