Beverly International
After testing products from Beverly International Nutrition Inc., we found 5 products that we allege to violate Proposition 65 regarding alleged heavy metal contamination. Below is the timeline of events of the case between ERC and Beverly International Nutrition Inc.
Notice of Violation I
On June 13, 2025, the Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Beverly International Nutrition Inc.
In this action, ERC alleges that this specific product, manufactured, distributed, or sold by Beverly International contains lead, a chemical listed under Proposition 65 as a developmental toxin and known to cause cancer. They expose consumers to levels requiring a Proposition 65 warning.
The products under investigation are:
Beverly International Up-Lift Tart Cherry – Lead
Notice of Violation II
On June 24, 2025, the Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Beverly International Nutrition Inc.
In this action, ERC alleges that this specific product, manufactured, distributed, or sold by Beverly International contains Perfluorooctanoic Acid (PFOA), a chemical listed under Proposition 65 as a toxin. They expose consumers to levels requiring a Proposition 65 warning.
The products under investigation are:
Beverly International PBP Plant-Based Protein Vanilla Protein Shake Mix – Perfluorooctanoic Acid (PFOA)
Notice of Violation III
On July 10, 2025, the Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Beverly International Nutrition Inc.
In this action, ERC alleges that this specific product, manufactured, distributed, or sold by Beverly International contains Perfluorooctane Sulfonate (PFOS), a chemical listed under Proposition 65 as a toxin. They expose consumers to levels requiring a Proposition 65 warning.
The products under investigation are:
Beverly International Ultra 40 Beef Liver Made with 100% Argentine Beef Liver – Perfluorooctane Sulfonate (PFOS)
Notice of Violation IV
On August 1, 2025, the Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Beverly International Nutrition Inc.
In this action, ERC alleges that this specific product, manufactured, distributed, or sold by Beverly International contains lead, a chemical listed under Proposition 65 as a toxin. They expose consumers to levels requiring a Proposition 65 warning.

Beverly International Mass Maker Ultra High-Potency Lean Weight Gainer Naturally & Artificially Flavored Delicious Vanilla Dietary Supplement – Lead
Settlement
A settlement was reached on November 20, 2025 in full satisfaction of all potential civil penalties, additional settlement payments, attorney's fees, and costs, Beverly International Nutrition Inc., shall make a total payment of $40,000.
CORRECTIVE ACTION
Beginning on the Compliance Date, Beverly International Nutrition shall be permanently enjoined from manufacturing for sale in the State of California, “Distributing into the State of California,” or directly selling in the State of California, any Lead Covered Product which exposes a person to a “Daily Lead Exposure Level” of more than 0.5 micrograms of lead per day and/or any PFOA Covered Product which exposes a person to a detectible level of PFOA and/or any PFOS Covered Product which exposes a person to a detectible level of PFOS per day unless such Covered Product meets the warning requirements under Section 3.2 (using the test methods specified herein). Covered Products already in the Stream of Commerce on the Compliance Date are expressly subject to the release set forth in Paragraph 6.2. For purposes of this Agreement, the term “Stream of Commerce” means that the Covered Products have been manufactured and labeled for sale and are no longer in the possession of or under the control of Beverly International Nutrition.
