Better Alt

After testing products from Azuretale Inc., individually and dba BetterAlt, we found 3 products we allege to violate Proposition 65 regarding heavy metal contamination. Below is the timeline of events of the case between ERC and BetterAlt.


Notice of Violation I

On March 26, 2025, the Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Azuretale Inc., individually and dba BetterAlt

In this action, ERC alleges that 1 specific product manufactured, distributed, or sold by BetterAlt, contains Perfluorooctanoic Acid (PFOA), chemicals listed under Proposition 65 as carcinogenic and reproductive toxins, exposing consumers to levels requiring a Proposition 65 warning. 

The products under investigation are:

  1. BetterAlt Muscle Pro Loaded Plant Protein Ashwagandha Safed Musli Iced Coffee Flavor - Perfluorooctanoic Acid (PFOA)


Notice of Violation II

On May 6, 2025, the Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Azuretale Inc., individually and dba BetterAlt

In this action, ERC alleges that 1 specific product manufactured, distributed, or sold by BetterAlt, contains Lead, a chemical listed under Proposition 65 as carcinogenic and a reproductive toxin, exposing consumers to levels requiring a Proposition 65 warning. 

The products under investigation are:

  1. BetterAlt Ova Care+ Cordyceps Magnesium Ashoka- Lead


Civil Complaint

Notice of Violation III

On August 28, 2025, the Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Azuretale Inc., individually and dba BetterAlt

In this action, ERC alleges that 1 specific product manufactured, distributed, or sold by BetterAlt, contains Lead, a chemical listed under Proposition 65 as carcinogenic and a reproductive toxin, exposing consumers to levels requiring a Proposition 65 warning. 

The products under investigation are:

  1. BetterAlt Boost Beet Root Powder - Lead


Settlement

A settlement was reached on October 28, 2025. In full satisfaction of all potential civil penalties, additional settlement payments, attorney's fees, and costs, Azuretale Inc., individually and dba BetterAlt, shall pay $50,000.00 in total.

Injunctive Relief: 

Beginning on the Effective Date, Humble Tea shall be permanently enjoined from manufacturing for sale in the State of California, “Distributing into the State of California,” or directly selling in the State of California, any Covered Product that exposes a person to a “Daily Lead Exposure Level” of more than 0.5 micrograms of lead per day unless it meets the warning requirements under Section 3.2.

Supplemental Settlement

A settlement was reached on November 14, 2025. In full satisfaction of all potential civil penalties, additional settlement payments, attorney's fees, and costs, Azuretale Inc., individually and dba BetterAlt, shall pay $50,000.00 in total.

Injunctive Relief: 

Beginning on the Effective Date, Azuretale shall be permanently enjoined from manufacturing for sale in the State of California, “Distributing into the State of California,” or directly selling in the State of California, any Lead Covered Product that exposes a person to a “Daily Lead Exposure Level” of more than 0.5 micrograms of lead per day and/or any PFOA Covered Product that exposes a person to a quantifiable level of PFOA that can be reliably achieved using industry standard methods for testing, unless the Lead Covered Product and/or PFOA Covered Product meets the warning requirements under Section 3.2.
