After testing products from Nutritional Medicinals, LLC, individually and dba Functional Formularies, Danone US, LLC, individually and dba Functional Formularies, Danone North America Public Benefit Corporation, individually and dba Functional Formularies Danone US, Inc., individually and dba Functional Formularies Danone North America LLC, individually and dba Functional Formularies, we discovered 8 products we allege to be in violation of Proposition 65 in regards to heavy metal contamination. Below is the timeline of events of the case between ERC and Functional Formularies.

Notice of Violation I

On October 27, 2025, the Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Functional Formularies

In this action, ERC alleges that 8 specific products manufactured, distributed, or sold by Danone North America LLC, individually and dba Functional Formularies, contain lead and/or Perfluorooctanoic Acid (PFOA), a chemical listed under Proposition 65 as carcinogenic and a reproductive toxin, exposing consumers to levels requiring a Proposition 65 warning.
