After testing products from Vejo, Inc., we found three products we allege to be in violation of Proposition 65 in regards to lead contamination. Below is the timeline of events of the case between ERC and Vejo, Inc.

NOTICE

On July 8, 2022 Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Vejo, Inc.

In this action, ERC alleges that three specific products manufactured, distributed, or sold by Vejo, Inc., contain lead, chemicals listed under Proposition 65 as a carcinogens and reproductive toxins, and expose consumers to levels requiring a Proposition 65 warning. 

The products under investigation are: 

1. Vejo Piña Greens Smoothie Blend
2. Vejo Mood Boost Banana & Mango Functional Blend
3. Vejo Banana Almond With Plant-Based Protein Blend

NOTICE II

On July 21, 2022 Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Vejo, Inc.

In this action, ERC alleges that three specific products manufactured, distributed, or sold by Vejo, Inc., contain lead and cadmium, chemicals listed under Proposition 65 as a carcinogens and reproductive toxins, and expose consumers to levels requiring a Proposition 65 warning. 

The products under investigation are: 

1. Vejo Spiced Chocolate
2. Vejo Tart Berry
3. Vejo Plant-Based Protein Natural Chocolate Flavor Protein Blend


COMPLAINT

ERC filed a Civil Complaint on January 13, 2023.


SETTLEMENT

A settlement was reached on February 23, 2023. In full satisfaction of all potential civil penalties, additional settlement payments, attorney's fees, and costs, Vejo, Inc. shall make a total payment of $26,000.00 to ERC.

CORRECTIVE ACTION

Beginning on the Effective Date (for internet warnings as described in Section 3.2) or thirty (30) days after the Effective Date (the “Compliance Date”) (for all other warning methods described in Section 3.2), as applicable, Vejo shall be permanently enjoined from manufacturing for sale in the State of California, “Distributing into the State of California,” or directly selling in the State of California, any Covered Product that exposes a person to a “Daily Lead Exposure Level” of more than 0.5 micrograms of lead per day and/or a “Daily Cadmium Exposure Level” of more than 4.1 micrograms of cadmium per day unless it meets the warning requirements under Section 3.2.
