Black Rifle Coffee Company, LLC

After testing products from Black Rifle Coffee Company, LLC, we found three products we allege to be in violation of Proposition 65 in regards to lead, cadmium, and mercury contamination. Below is the timeline of events of the case between ERC and Black Rifle Coffee Company, LLC.

NOTICE

On July 6, 2022 Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Black Rifle Coffee Company, LLC.

In this action, ERC alleges that three specific products manufactured, distributed, or sold by Black Rifle Coffee Company, LLC., contain lead, cadmium and/or mercury, chemicals listed under Proposition 65 as a carcinogens and reproductive toxins, and expose consumers to levels requiring a Proposition 65 warning. 

The products under investigation are: 

1. CC17 Combat Cocoa
2. Black Rifle Coffee Company Espresso Mocha
3. Black Rifle Coffee Company Espresso With Cream


COMPLAINT

ERC filed a Civil Complaint on January 11, 2023.


SETTLEMENT

A settlement was reached on February 28, 2023. In full satisfaction of all potential civil penalties, additional settlement payments, attorney's fees, and costs, FNX Sport L.L.C. shall make a total payment of $ 150,000.00 to ERC.

CORRECTIVE ACTION

Beginning on the Effective Date, Black Rifle Coffee Company shall be permanently enjoined from manufacturing for sale in the State of California, “Distributing into the State of California,” or directly selling in the State of California, any Covered Product that exposes a person to a “Daily Lead Exposure Level” of more than 0.5 micrograms of lead per day and/or “Daily Cadmium Exposure Level” of more than 4.1 micrograms of cadmium per day and/or “Daily Mercury Exposure Level” of more than 0.3 micrograms of mercury per day unless it meets the warning requirements under Section 3.2. The requirements of Sections 3.1 and 3.2 do not apply to Covered Products that “enter the stream of commerce” prior to the Effective Date. For purposes of this Consent Judgment, the term “enter the stream of commerce” means that manufactured Covered Products have been put into final packaging for consumer sale and are no longer in the possession of or under the control of Black Rifle Coffee Company.
