Below is the timeline of events of the case between ERC and Origin Labs, LLC, individually and dba Origin USA and/or Jocko.
Notice of Violation I
On May 27, 2021, the Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Origin Labs, LLC, individually and dba Origin USA and/or Jocko.
In this action, ERC alleges that three specific products manufactured, distributed, or sold by Origin Labs, LLC, individually and dba Origin USA and/or Jocko contain mercury, a chemical listed under Proposition 65 as a carcinogen and reproductive toxin, and expose consumers to mercury at a level requiring a Proposition 65 warning. Mercury is allegedly in the products listed below:
The products are:
1. Jocko Mölk JockoFuel Smashing Pumpkin Protein
2. Jocko Mölk JockoFuel Vanilla Gorilla Protein
3. Jocko Mölk JockoFuel Chocolate Peanut Butter Protein
Notice of Violation II
On June 10, 2021 the Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Origin Labs, LLC, individually and dba Origin USA and/or Jocko.
In this action, ERC alleges that two specific products manufactured, distributed, or sold by Origin Labs, LLC, individually and dba Origin USA and/or Jocko contain mercury and lead, two chemicals listed under Proposition 65 as carcinogens and reproductive toxins, and expose consumers to mercury and lead at levels requiring a Proposition 65 warning. Mercury and Lead are allegedly in the products listed below:
1. Jocko Mölk JockoFuel Mint Chocolate Protein
2. Jocko Mölk JockoFuel Naturally Flavored The Darkness Chocolate Protein
Notice of Violation III
One June 24, 2021 the Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Origin Labs, LLC, individually and dba Origin USA and/or Jocko.
In this action, ERC alleges that two specific products manufactured, distributed, or sold by Origin Labs, LLC, individually and dba Origin USA and/or Jocko contain lead, a chemical listed under Proposition 65 as a carcinogen and reproductive toxin, and expose consumers to lead at a level requiring a Proposition 65 warning. Lead is allegedly in the products listed below:
1. Jocko Discipline by JockoFuel Citrus Psycho
2. Jocko Discipline by JockoFuel Jocko Pom'R
Settlement
A settlement was reached on September 21, 2021. In full satisfaction of all potential civil penalties, additional settlement payments, attorney's fees, and costs, Origin Labs, LLC, individually and dba Origin USA and/or Jocko, shall pay $75,000 in total.
Injunctive Relief:
3.1 Beginning on the Effective Date, Origin Labs shall be permanently enjoined from manufacturing for sale in the State of California, “Distributing into the State of California,” or directly selling in the State of California, any Covered Product that exposes a person to a “Daily Lead Exposure Level” of more than 0.5 micrograms of lead per day and/or “Daily Mercury Exposure Level” of more than 0.3 micrograms of mercury per day unless it meets the warning requirements under Section 3.2.
