TB12
After testing products, we found 3 products from TB12, Inc. we allege are in violation of Proposition 65 regarding heavy metal contamination. Below is the timeline of events of the case between ERC and TB12.
NOTICE I
On September 6, 2024, the Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against TB12.
In this action, ERC alleges that three specific products manufactured, distributed, or sold by TB12 contain lead and cadmium, chemicals listed under Proposition 65 as carcinogens and reproductive toxins. It exposes consumers to levels requiring a Proposition 65 warning.
The products under investigation are:
TB12 Plant-Based Protein Bar Peanut Butter Chocolate Chip Flavored – Lead
TB12 Plant-Based Protein Bar Turmeric Cashew Honey - Lead
TB12 Plant-Based Protein Bar Chocolate Cacao Crunch – Lead, Cadmium
Settlement
A settlement was reached on December 9, 2024. In full satisfaction of all potential civil penalties, additional settlement payments, attorney's fees, and costs, TB12, Inc. shall pay ERC $25,000.00 in total.
Injunctive Relief:
Beginning on the Effective Date, TB12 shall be permanently enjoined from manufacturing for sale in the State of California, “Distributing into the State of California,” or directly selling in the State of California, any Covered Product which exposes a person to a “Daily Lead Exposure Level” of more than 0.5 micrograms of lead per day and/or a “Daily Cadmium Exposure Level” of more than 4.1 micrograms per day unless it meets the warning requirements under Section 3.2. The injunctive requirements of Section 3 shall not apply to Covered Products that are already in the stream of commerce as of the Effective Date, which Covered Products are expressly subject to the releases provided in Section 6. For purposes of this Agreement, the term “in the stream of commerce” means that manufactured Covered Products have been put into final packaging for consumer sale and are no longer in the possession of or under the control of TB12.
