Below is the timeline of events of the case between ERC and USANA Health Sciences, Inc., individually and dba Rise Bar.

On November 16, 2023, the Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against USANA Health Sciences, Inc., individually and dba Rise Bar.
In this action, ERC alleges that three specific products, manufactured, distributed, or sold by USANA Health Sciences, Inc., individually and dba Rise Bar contain lead, a chemical listed under Proposition 65 as a carcinogen and a reproductive toxin, and expose consumers to levels requiring a Proposition 65 warning.

In this action, ERC alleges that six specific products, manufactured, distributed, or sold by Rise Wellness Inc., individually and dba Rise Bar contain lead and/or cadmium, chemicals listed under Proposition 65 as carcinogens and reproductive toxins, and expose consumers to levels requiring a Proposition 65 warning.

Settlement
A settlement was reached on May 23, 2025. In full satisfaction of all potential civil penalties, additional settlement payments, attorney's fees, and costs, USANA Health Sciences, Inc., individually and dba Rise Bar Rise Wellness, Inc. shall pay $140,000.00 in total.
Injunctive Relief:
3.1 Beginning on the Compliance Date, Rise Wellness, Inc. shall be permanently enjoined from manufacturing for sale in the State of California, “Distributing into the State of California,” or directly selling in the State of California, any Covered Product that exposes a person to a “Daily Lead Exposure Level” of more than 0.5 micrograms of lead per day and/or “Daily Cadmium Exposure Level” of more than 4.1 micrograms of cadmium per day unless it meets the warning requirements under Section 3.2. The requirements of Sections 3.1 and 3.2 do not apply to Covered Products that “enter the stream of commerce” prior to the Compliance Date. For purposes of this Consent Judgment, the term “enter the stream of commerce” means that manufactured Covered Products have been put into final packaging for consumer sale and are no longer in the possession of or under the control of Rise Wellness, Inc.
