Below is the timeline of events of the case between ERC and Nutra Holdings, Inc., individually and dba Cira Nutrition.
Notice I
On September 14, 2023, Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Nutra Holdings, Inc., individually and dba Cira Nutrition.
In this action, ERC alleges that three specific products manufactured, distributed, or sold by Nutra Holdings, Inc., individually and dba Cira Nutrition, contain lead and cadmium, chemicals listed under Proposition 65 as carcinogens and reproductive toxins, and expose consumers to levels requiring a Proposition 65 warning.
The products under investigation are:
1. Cira Bright Vegan Protein Chocolate Protein Powder Drink Mix
2. Cira Bright Vegan Protein Vanilla Protein Powder Drink Mix
3. Cira Pre-Game Pre-Workout Peach Bellini

On September 28, 2023, Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Nutra Holdings, Inc., individually and dba Cira Nutrition.
In this action, ERC alleges that six specific products manufactured, distributed, or sold by Nutra Holdings, Inc., individually and dba Cira Nutrition, contain lead, chemicals listed under Proposition 65 as carcinogens and reproductive toxins, and expose consumers to levels requiring a Proposition 65 warning.
The products under investigation are:
1. Cira Bright Whey Protein Cinnamon Swirl Protein Powder Drink Mix - Lead
2. Cira Aminos Intra-Workout Pop & Rock - Lead
3. Cira Glow-Getter Greens Superfood Powder Appletini - Lead
4. Cira Pump Stim-Free Pre-Workout Peach Bellini - Lead
5. Cira Pump Stim-Free Pre-Workout Pop & Rock - Lead
6. Cira Aminos Intra-Workout Pink Candy - Lead
Settlement
A settlement was reached on April 12, 2024. In full satisfaction of all potential civil penalties, additional settlement payments, attorney's fees, and costs, Nutra Holdings, Inc. Cira Nutrition Inc. shall pay $22,000.00 in total.
Injunctive Relief:
3.1 Cira Nutrition contends that it no longer sells or distributes the Covered Products to consumers in the State of California and that it does not intend to resume selling or distributing the Covered Products to consumers in the State of California in the foreseeable future. Accordingly, beginning on the Effective Date, Cira Nutrition shall be permanently enjoined from manufacturing for sale in the State of California, “Distributing into the State of California,” or directly selling in the State of California, any Covered Product that does not include a warning as set out in Section 3.4 below (collectively referred to as “California Sales Practices”).
