Prime Hydration

After testing products from Prime Hydration, LLC., we found fourteen products we allege to violate Proposition 65 regarding heavy metal contamination. Below is the timeline of events of the case between ERC and Prime Hydration, LLC.

Notice of Violation I

On November 1, 2023, the Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Prime Hydration, LLC.

In this action, ERC alleges that three specific products, manufactured, distributed, or sold by Prime Hydration, LLC., contain lead, a chemical listed under Proposition 65 as a carcinogen and reproductive toxin, and expose consumers to levels requiring a Proposition 65 warning. 

The products under investigation are:

  1. Prime Hydration Drink Strawberry Watermelon - Lead

  2. Prime Hydration Drink Meta Moon - Lead

  3. Prime Hydration Drink Ice Pop - Lead


Notice of Violation II

On November 21, 2023, the Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Prime Hydration, LLC.

In this action, ERC alleges that five specific products, manufactured, distributed, or sold by Prime Hydration, LLC., contain lead and mercury, two chemicals listed under Proposition 65 as carcinogens and reproductive toxins, and expose consumers to levels requiring a Proposition 65 warning. 

The products under investigation are:

  1. Prime Hydration Drink Blue Raspberry - Lead, Mercury

  2. Prime Energy Drink Strawberry Watermelon - Lead

  3. Prime Energy Drink Lemon Lime - Lead

  4. Prime Energy Drink Orange Mango - Lead

  5. Prime Hydration Drink Glowberry - Lead


Notice of Violation III

On March 27, 2024, the Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Prime Hydration, LLC.

In this action, ERC alleges that six specific products, manufactured, distributed, or sold by Prime Hydration, LLC., contain lead and mercury, two chemicals listed under Proposition 65 as carcinogens and reproductive toxins, and expose consumers to levels requiring a Proposition 65 warning. 

The products under investigation are:

  1. Prime Hydration Drink Orange - Lead

  2. Prime Hydration Drink Tropical Punch – Lead, Mercury

  3. Prime Hydration Drink Lemonade - Lead

  4. Prime Energy Drink Blue Raspberry - Lead

  5. Prime Energy Drink Ice Pop – Lead, Mercury

  6. Prime Energy Drink Tropical Punch – Lead

Settlement

A settlement was reached on September 6, 2024. In full satisfaction of all potential civil penalties, additional settlement payments, attorney's fees, and costs, Prime Hydration LLC shall pay ERC $150,000.00 in total.

Injunctive Relief: 

Beginning on the Effective Date, Prime shall be permanently enjoined from manufacturing for sale in the State of California, “Distributing into the State of California,” or directly selling in the State of California, any Covered Product that exposes a person to a “Daily Lead Exposure Level” of more than 0.5 micrograms of lead per day and any Mercury Covered Product that exposes a person to a “Daily Mercury Exposure Level” of more than 0.3 micrograms of mercury per day unless it meets the warning requirements under Section 3.2.

Judgement

Judgement Date: 01/22/2026
