Below is the timeline of events of the case between ERC and Bob’s Red Mill.
Notice of Violation I
On April 11, 2019, Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Bob’s Red Mill.
In this action, ERC alleges that three specific products manufactured, distributed, or sold by Bob’s Red Mill, contain lead and/or cadmium, chemicals listed under Proposition 65 as a carcinogen and reproductive toxin, and expose consumers to lead at a level requiring a Proposition 65 warning. All products below allegedly contain lead.
These products are:
1. Bob's Red Mill Premium Quality Protein & Fiber Nutritional Booster with Chia & Probiotics Unflavored
2. Bob's Red Mill Naturally Flavored Chai Protein Powder Nutritional Booster with Chia & Probiotics Sweetened with Monk Fruit
3. Bob's Red Mill Naturally Flavored Vanilla Protein Powder Nutritional Booster with Chia & Probiotics Sweetened with Monk Fruit

Settlement
A settlement was reached on November 12, 2025. In full satisfaction of all potential civil penalties, additional settlement payments, attorney's fees, and costs, Bob's Red Mill Natural Foods Inc. Bob's Red Mill Export, Inc., shall pay $40,000.00 in total.
Injunctive Relief:
3.1 Beginning on the Effective Date, Bob’s Red Mill shall be permanently enjoined from manufacturing for sale in the State of California, “Distributing into the State of California,” or directly selling in the State of California, any Covered Products which expose a person to a “Daily Lead Exposure Level” of more than 0.5 micrograms of lead per day unless it meets the warning requirements under Section 3.2.

Judgment
A judgment was reached on February 8, 2021. In full satisfaction of all potential civil penalties, additional settlement payments, attorney's fees, and costs, Bob's Red Mill Natural Foods Inc. Bob's Red Mill Export, Inc., shall pay $40,000.00 in total.
