Below is the timeline of events of the case between ERC and Nuzest.


Notice of Violation I

On April 6, 2021, Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Nuzest.

In this action, ERC alleges that TWO specific products manufactured, distributed, or sold by Nuzest, contain lead, a chemical listed under Proposition 65 as a carcinogen and reproductive toxin, and exposes consumers to lead at a level requiring a Proposition 65 warning. Lead is alleged in the products listed below.  

The products are:

1. Nuzest Nutrition For Life Clean Lean Protein Premium European Golden Pea Protein Just Natural
2. Nuzest Nutrition For Life Kids Good Stuff Multivitamin Drink Mix Vanilla Caramel


Notice of Violation II

On April 20, 2021, Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Nuzest.

In this action, ERC alleges that TWO additional specific products manufactured, distributed, or sold by Nuzest, contain lead, a chemical listed under Proposition 65 as a carcinogen and reproductive toxin, and exposes consumers to lead at a level requiring a Proposition 65 warning. Lead is alleged in the products listed below.  

The products are:

1. Nuzest Nutrition For Life Kids Good Stuff Multivitamin Drink Mix Wild Strawberry
2. Nuzest Nutrition For Life Clean Lean Protein Bar Vanilla Almond


Settlement

A settlement was reached on August 30, 2021. In full satisfaction of all potential civil penalties, additional settlement payments, attorney's fees, and costs, Riff Enterprises, Inc., individually and dba Nuzest USA and Nuzest, shall pay $19,999.00 in total.

Injunctive Relief: 

Beginning on the Effective Date, Nuzest USA shall continue to not manufacture for sale in the State of California, "Distribute into the State of California," or directly sell in the State of California, any Covered Product which exposes a person to a "Daily Lead Exposure Level" of more than 0.5 micrograms of lead per day unless it meets the warning requirements under Section 3.2.
