Below is the timeline of events of the case between ERC and Huel, Inc.
Notice of Violation I
On September 23, 2021, Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Huel, Inc.
In this action, ERC alleges that two specific products manufactured, distributed, or sold by Huel, Inc., contain lead and/or cadmium, chemicals listed under Proposition 65 as carcinogens and reproductive toxins, and expose consumers to levels requiring a Proposition 65 warning.
The products under investigation are:
1. Huel Nutritionally Complete Food Black Edition Strawberry Shortcake Flavor
2. Huel Nutritionally Complete Food Black Edition Banana Flavor
Notice of Violation II
On September 30, 2021, Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Huel, Inc.
In this action, ERC alleges that one specific product manufactured, distributed, or sold by Huel, Inc., contains lead and cadmium, chemicals listed under Proposition 65 as carcinogens and reproductive toxins, and exposes consumers to levels requiring a Proposition 65 warning.
The product under investigation is:
1. Huel Nutritionally Complete Food, Black Edition, Coffee Caramel Flavor
Notice of Violation III
On October 7, 2021, Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Huel, Inc.
In this action, ERC alleges that three specific products manufactured, distributed, or sold by Huel, Inc., contain lead and cadmium, chemicals listed under Proposition 65 as carcinogens and reproductive toxins, and expose consumers to levels requiring a Proposition 65 warning.
The products under investigation are:
1. Huel Nutritionally Complete Food v3.0, Caffè Latte Flavor
2. Huel 100% Nutritionally Complete Drink Vanilla
3. Huel Nutritionally Complete Food Black Edition, Chocolate
Notice IV
On October 22, 2021, Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Huel, Inc.
In this action, ERC alleges that eight specific products manufactured, distributed, or sold by Huel, Inc., contain lead and cadmium, chemicals listed under Proposition 65 as carcinogens and reproductive toxins, and expose consumers to levels requiring a Proposition 65 warning.
The products under investigation are:
1. Huel Nutritionally Complete Food Black Edition Unflavored & Unsweetened
2. Huel 100% Nutritionally Complete Protein Unflavored & Unsweetened
3. Huel 100% Nutritionally Complete Protein Vanilla Caramel
4. Huel Nutritionally Complete Food v3.0 Vanilla Flavor
5. Huel Nutritionally Complete Food v3.0 Banana Flavor
6. Huel Ready-to-drink Complete Meal v1.0 Berry Flavor
7. Huel Ready-to-drink Complete Meal v1.0 Banana Flavor
8. Huel Ready-to-drink Complete Meal Chocolate Flavor
Settlement
A settlement was reached on March 21, 2022 in full satisfaction of all potential civil penalties, additional settlement payments, attorney's fees, and costs, Huel Inc. shall pay $13,677 in satisfaction of civil penalties, costs, and legal fees.
Injunctive Relief:
Beginning on the Effective Date, Huel shall be permanently enjoined from manufacturing for sale in the State of California, "Distributing into the State of California," or directly selling in the State of California, any Covered Product which exposes a person to a "Daily Lead Exposure Level" of more than 0.5 micrograms of lead per day and/or a "Daily Cadmium Exposure Level" of more than 4.1 micrograms of cadmium per day unless it meets the warning requirements.
