Earth’s Creation
After testing products from Earth's Creation USA, Inc., individually and dba EC Sports we found 9 products that we allege to violate Proposition 65 regarding alleged heavy metal contamination. Below is the timeline of events of the case between ERC and Earth's Creation USA, Inc., individually and dba EC Sports.
Notice of Violation I
On July 17, 2025, the Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Earth's Creation USA, Inc., individually and dba EC Sports.
In this action, ERC alleges that these specific products, manufactured, distributed, or sold by Earth’s Creation, contain lead, a chemical listed under Proposition 65 as a developmental toxin and known to cause cancer. They expose consumers to levels requiring a Proposition 65 warning.

Notice of Violation II

A settlement was reached on July 6, 2026 In full satisfaction of all potential civil penalties, additional settlement payments, attorney's fees, and costs, Earth’s Creation USA, Inc. shall pay $45,000 in satisfaction of civil penalties, costs, and legal fees.
Injunctive Relief:
Beginning on the Effective Date, Earth’s Creation USA Inc. is permanently enjoined from manufacturing for sale in California, distributing into California, or directly selling in California any Covered Product that exposes a person to a Daily Lead Exposure Level of more than 0.5 micrograms of lead per day, unless the product meets the warning requirements established in the Consent Judgment..
