After testing products from KinderFarms LLC, we found four products we allege to be in violation of Proposition 65 in regards to heavy metal contamination. Below is the timeline of events of the case between ERC and KinderFarms LLC.


NOTICE I

On June 14, 2024, the Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against KinderFarms LLC.

In this action, ERC alleges that 2 specific products, manufactured, distributed, or sold by KinderFarms LLC, contain lead and mercury, chemicals listed under Proposition 65 as carcinogens and reproductive toxins, and expose consumers to levels requiring a Proposition 65 warning. 

The products under investigation are:

  1. Kindersprout Organic Plant Protein Kids Nutrition Shake Chocolate Naturally Flavored - Lead

  2. Kinderlyte Natural Medical Grade Hydration Natural Oral Electrolyte Solution Orange Naturally Flavored – Lead, Mercury 


NOTICE II

On June 28, 2024, the Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against KinderFarms LLC.

In this action, ERC alleges that 2 specific products, manufactured, distributed, or sold by KinderFarms LLC, contain Perfluorooctanoic Acid (PFOA), a chemical listed under Proposition 65 as a carcinogen and a reproductive toxin, exposing consumers to levels of this contaminant requiring a Proposition 65 warning. 

The products under investigation are:

  1. Kindersprout Organic Plant Protein Kids Nutrition Shake Chocolate Naturally Flavored -Perfluorooctanoic Acid (PFOA)

  2. Kindersprout Organic Plant Protein Kids Nutrition Shake Vanilla Naturally Flavored - Perfluorooctanoic Acid (PFOA)


Settlement

A settlement was reached on December 18, 2024. In full satisfaction of all potential civil penalties, additional settlement payments, attorney's fees, and costs, Kinderfarms shall pay $8,100.00 in total.

Injunctive Relief: 

Beginning on the Compliance Date, which date is 90-days after the Effective Date, KinderFarms shall be permanently enjoined from manufacturing for sale in the State of California, "Distributing into the State of California," or directly selling in the State of California, any Covered Product which exposes a person to a "Daily Lead Exposure Level" of more than 0.5 micrograms of lead per day and/or any PFOA above reliably detectable levels for the product being tested using available technologies, unless it meets the warning requirements under Section 3.2.
