Below is the timeline of events of the case between ERC and Nooma.
Notice of Violation I
On July 14, 2022 Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Nooma.
In this action, ERC alleges that three specific products manufactured, distributed, or sold by Nooma, contain mercury, a chemical listed under Proposition 65 as a carcinogen and reproductive toxin, and expose consumers to levels requiring a Proposition 65 warning.
The product under investigation is:
1. NOOMA Organic Sport Energy Drink Dragon Fruit
2. NOOMA Sports Drink Clean Hydration Blueberry Peach
3. NOOMA Organic Sport Hydration Drink Mango
Notice of Violation II
On August 18, 2022 Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Nooma.
In this action, ERC alleges that one specific products manufactured, distributed, or sold by Nooma, contains lead, a chemical listed under Proposition 65 as a carcinogen and reproductive toxin, and exposes consumers to levels requiring a Proposition 65 warning.
The product under investigation is:
1. NOOMA Organic Sport Energy Drink Pineapple Mango
Civil Complaint
On March 1, 2023, the Environmental Research Center filed a Civil Complaint against Non Acidic Beverages, LLC, individually and dba NOOMA. To view the full civil complaint, click here.

Settlement
A settlement was reached on May 12, 2023. In full satisfaction of all potential civil penalties, additional settlement payments, attorney's fees, and costs, Non Acidic Beverages, LLC, individually and dba NOOMA, shall pay $40,000.00 in total.
Injunctive Relief:
3.1 Beginning on the Effective Date, NOOMA shall be permanently enjoined from manufacturing for sale in the State of California, “Distributing into the State of California,” or directly selling in the State of California, any Covered Product that exposes a person to a “Daily Lead Exposure Level” of more than 0.5 micrograms of lead per day and/or a “Daily Mercury Exposure Level” of more than 0.3 micrograms of mercury per day unless it meets the warning requirements under Section 3.2.
