Revealing the Prop 65 process: What’s a N.O.V.?

How to look up Notice of Violations (NOVs)

Surprise: Warning you about toxins in your supplements is a process. I don’t get to just test and tell YOU. It’s test then tell the company of the allegations first. How can you cut out the wait time? I’ll show you.

N.O.V.s are your advanced way to be in the know about allegations of toxins in the products you & I use every day. Products like fitness, nutrition, and herbal supplements.

What’s a N.O.V., how it works, and why you should care

I have to send the company a letter letting them know ERC tested their product(s) and that ERC alleges that said product(s) are not compliant with Prop 65. They have 60 days to respond. But that doesn't mean the problem is resolved in 60 days. It can take YEARS!

Wanna know about Notices of Violation issued to companies before years of litigation? I will educate you on how to look up N.O.V.s for FREE. Go to http://oag.ca.gov/prop65/60-day-notice-search

There are several search options, but the easiest are plaintiff and defendant.

Plaintiff – This is the company filing the notice, like ERC.

Type in a company, hit enter, and get results. You can click on the pdf link to read the actual NOV.

It’s important to use the full name & quotations marks, or else you’re going to get EVERY result with ANY part of the name entered. Yikes! For example, instead of ERC try "Environmental Research Center."

Defendant – This is any company notified that they are allegedly in violation of Prop 65.

Enter the company name in the Defendant field and hit enter.

Click on the pdf link and, Voila! There’s the N.O.V. naming the products that are allegedly non-compliant.

There you have it. Now you know what an N.O.V. is and how you can use it to protect yourself!

Be in the know: because even reading ingredient labels might not tell the whole story.

During 2015 ERC purchased and tested over 2,885 products. ERC also issued 86 Notices of Violations to various companies. Further, in 2015 ERC had 69 settlements that involved 814 products.
